NO ENTRY FEE. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. By entering into the Survey Sweepstakes (“Sweepstakes”), you accept these official rules Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.

Eligibility: The “Survey Sweepstakes” is open only to legal residents of the US and Canada Only, and respondents who are 18 years of age or older at the time of entry. Employees of Sponsors, and their respective parents, affiliate companies, subsidiaries, promotion>agencies, suppliers and members of their immediate families, are not eligible. Void where prohibited by law. For purposes of this Promotion, “immediate family” is defined as spouses, parents, children, siblings and their respective spouses, regardless of whether they reside in the same household.

Timing: The Promotion begins date March 16, 2021 at 12:01AM EST and ends on March 30 2021 at 11:59pm EST (the “Promotion Period”).

How to Enter: The entry deadline is March 30, 2021 (“Entry Deadline”). During the Promotion Period, entrants must complete the survey and submit respondent’s email address and mobile phone number when prompted for one (1) entry. A valid mobile phone number is required to redeem the Goody gift and credit. Limit one entry per person. No more than one person can enter using the same email address or phone number. Entrants submitting multiple entries or violating any of these Official Rules may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

Entry Errors: Sponsor and Prize Provider are not responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified. Sponsor and Prize Provider are not responsible if online service or equipment is interrupted including without limitation (1) interruptions to any network, server, Internet, Web site, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, (4) other errors of any kind, whether human, technical, mechanical or electronic, (5) the incorrect or inaccurate capture of information or the failure to capture any such information, or (6) printing or typographical errors.

Selection of Winners: A random drawing will be conducted on or about date March 31, 2021 by In Bloom from all eligible entries received, and 5 winners will be selected. The winners will be selected at random by a computer program that randomly chooses the winner from among all eligible entries received. Odds of winning depend on the number of eligible entries received. Potential prize winners will be notified via e-mail within 5 five days of the prize drawing. Entrants are solely responsible for ensuring that all e-mail information is up-to-date and accurate. Notices returned as undeliverable will result in the disqualification of the potential prize winner and an alternate winner will be selected. If a selected winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the prize may be forfeited and an alternate winner selected from remaining valid, eligible entries timely submitted. Sponsor’s decisions as to the random drawing are final. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account specified in the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Prize(s): One (1) prize per winner of the Sweepstakes, consisting of the following:
One (1) $100 Voucher to use at tobeinbloom.com. Valid for 30 days.
One (1) P.Volve Ultimate Kit, including a 3-month digital membership and complimentary access to live virtual studio classes.
One (1) Goody $50 Premium Gift credit. A valid mobile phone number is required to redeem the Goody gift and credit. The recipient may select another gift of equal or lesser value when redeeming on Goody.

The approximate retail value (“ARV”) of the prize is $354.99. Any difference between the ARV and actual value of the prize, if any, will not be awarded. Any portion of the prize not used by winner will be forfeited.

Sponsor will not replace any lost or stolen prizes or prize components. Winner may not transfer, assign, or substitute the prize, or redeem the prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize is awarded "as is" without any warranty or guarantee, either express of implied by Sponsor. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. Allow four (4) to six (6) weeks for delivery of prizes.

Total value of all prizes to be awarded: $1,774.95.

Terms and conditions of Prize Drawing: (1) Prizes cannot be combined with any other offer or discount; (2) Income and other taxes are the sole responsibility of winners. (3) Prize is non-transferable, non-refundable and has no cash value if not used.

Acceptance of Official Rules: As a condition of entry, participants fully and unconditionally agree to these Official Rules, to the Terms and Conditions of Prize Drawing and to Sponsor’s decisions, which are final and binding in all respects. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

Limitations on Liability: IN NO EVENT WILL SPONSOR OR ANY PRIZE PROVIDER BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE SWEEPSTAKES, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SPONSOR OR ANY PRIZE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnification. You agree to release, indemnify, defend and hold Sponsor, Prize Provider, and their respective parent, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Sweepstakes, harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Sweepstakes or acceptance or use of a prize or parts thereof, including, without limitation, (i) any condition caused by events beyond Sponsor’s control that may cause the Sweepstakes to be disrupted or corrupted; (ii) the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; and (iii) any printing or typographical errors in any materials associated with the Sweepstakes.

Additional Considerations. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Sweepstakes are compromised, without liability to the entrant. Sponsor reserves the right to disqualify any entrant or winner, as determined by Sponsor, in its sole discretion.

Governing Law and Choice of Forum. These Official Rules are governed by the law of the State of New York, without reference to rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Sweepstakes or these Official Rules must be brought in either the federal courts located in the Southern District of New York or the state courts located in New York City, New York.

Use of Data: Sponsor may collect personal data about entrants and share data collected with third parties in accordance with its privacy policy, located at https://tobeinbloom.com/pages/privacy, and as may be more specifically set forth in these Official Rules. The only use for email address is to alert the winner of their status. Sponsor will be using the data collected and has rights to that data collected through the survey.

Winner’s List, Official Rules. For a list of prize winners or a copy of these Official Rules, send your request via email message to help@tobeinbloom.com with “Winner’s list” as the email subject and INBLOOM Survey Sweepstakes specified in the body of the email. Requests must be received within four (4) weeks of the end of the Promotion Period.
